Está claro que si los castros se van del poder, eso seria por ahora el paso mas importante para poder lograr la Reconciliación Nacional.
Pero los que entendemos el Caso Cubano sabemos que el problema es mucho mas complejo que eso y que no bastará con que se vaya la familia castro del poder para lograr la Reconciliación Política Nacional; porque aún aunque se vayan los tiranos, la política cubana sigue estando todavía demasiado polarizada, porque siguen estando agrupada en dos grandes FOROS con un enorme antagonismo ideológico:
La Izquierda y la Derecha cubana.
Dos grandes FOROS ideológico que tienen tremenda inmadurez politica, tremenda falta de responsabilidad patriótica, que en la mayoría de los responden a intereses foráneos, mas que a intereses patrióticos y por eso con sus proyectos solo alimentan el odio entre los cubanos.
Dos grandes FOROS ideológicos con tremenda falta de pulcritud en sus liderazgos y con un ego personal que no los deja ver los problemas del país:
Es decir, el problema de la sociedad cubana es político y va de corregir o enmendar muchas actitudes personales que nada tienen que ver con los castros y por tanto, solucionarlos van mas alla de los castros, incluso hasta de los mismos cubanos:

Sabias que nosotros los cubanos tambien tenemos una Constitucion Soberana como ustedes?
Al igual que sus Constituciones Soberanas, nuestra Constitucion Soberana de 1940 (por sus siglas mas conocidas C-40), es la única hecha por los cubanos sin la injerencia de potencias extrajeras; y además:
Nunca ha sido derogada por el Soberano Pueblo Cubano; porque nunca fue Restituida tampoco!
Al contrario de lo que se ha dicho en todos los Foros Políticos Mundiales desde 1952, o desde la Habana, Miami, Washington, Madrid, Toronto, la ONU, la OEA, el Vaticano, el Parlamento Europeo, la Comunidad Europea y demas conversaciones internas entre los gobiernos libres e instituciones internacionales occidentales:
1-En Cuba no tenemos un problema económico, un problema social, un problema cultural, un problema artístico, un problema de libertad de expresión, un problema ideológico, un problema militar,... o que no tengamos pensamiento fundador como nación.
2-En Cuba no tenemos un problema de falta de abundancia de recursos naturales, un clima agresivo, no estamos aislados en medio de un océano, en Cuba no hay hambre porque solo tengamos una cosecha agrícola al año, porque seamos un país pequeno (ocupamos el 106 entre 240 paises); tampoco tenemos un problema de fatalismo geográfico, o de fatalismo geopolitico.
3-En Cuba no tenemos un problema migratorios como dicen ahora, de tipo trampolín, o de cadena familiar hacia EEUU desde el estrecho de la Florida o a través de decenas de paises.
4-Ni creemos que la solución del Caso Cubano va de HACER DENUNCIAS de los abusos, la represión, los golpes, las multas, las patadas, los juicios, los encarcelamientos, las torturas, los asesinatos; como se ha hecho por 62 años y según parece muchos pretenden seguir haciéndolo hasta el infinito.
5-Ni siquiera en esencia, es un problema jurídico o de violación de los Derechos Humanos; porque la Carta de los Derechos Humanos no es vinculante a nigun país, sino solo eso; una Carta de Intención que nigun país esta obligado a cumplir al nivel que si esta obligado a cumplir su Constitucion Soberana.
Todo lo anterior que enumeramos, solo es una parte de los miles de EFECTOS COLATERALES que provoca la violación de la Constitucion de 1940 o lo que es lo mismo:
Son los EFECTOS COLATERALES del Golpe de Estado continuo a la Constitución de 1940 desde 1952, por parte de los Caudillos Proyectistas cubanos.

En Cuba solo tenemos un problema; que es Político y se soluciona restituyendo la Constitucion de 1940.
El problema cubano es netamente político, porque desde 1952 hay que sentar en la misma mesa a la Izquierda que en 1959 secuestro el poder profanado la Constitucion de 1940 con la Ley Fundamental y ahora se rige por su continuidad, la Constitucion del 2019 y a la Derecha que quiere una Constitucion Nueva (y como las leyes no son retroactivas, tendrías que pagar las deudas de los violadores de la C-40 y por lo mismo; tampoco se podría hacer justicia de cara al pasado), mas o menos al estilo de los Estatutos Constitutivos de Batista, esos que tambien profanaron la Constitucion de 1940 o en su defecto, la Restitución de la Constitucion de 1901, que por no ser soberana, por no defender al pueblo cubano si fue derogada soberanamente en 1940, y eso señores 69 años demuestran que es políticamente imposible de lograrse; porque que dividen el Caso Cubano en dos soluciones ideológicas, en dos ideas excluyentes, en dos Foros antagónicos y es por eso que la mayoría del pueblo se queda al margen de las soluciones que ustedes pretenden darle a Caso Cubano, lo que conlleva al final que el grupo que toma el poder en cada etapa, tenga que recurrir a la violencia para imponerle al pueblo que se quedó al margen del diálogo, su proyecto personal.
Ese diálogo político de reconciliación nacional, sólo seria posible a través de un factor común soberano, legal, de unidad politica, que tenga dentro si todo nuestro pensamiento fundador, todos los anhelos de los Mambises, el de los independentistas de la 1ra Republica; algo que contenga un verdadero equilibrio donde desde nuestros intereses y gustos personales, todos los cubanos ganemos algo:
Y esos requisitos señores solo los cumple la Constitucion de 1940!
Cualquier otra cosa que no sea la Restitución de la Constitucion de 1940, aparte de ser ilegal, de ser una Ley Fundamental de un grupito con poder o dinero; en el mejor de los casos, sólo mantendrá el mismos estado actual de apatía politica y bostezos que le provocan ahora la Izquierda y la Derecha al pueblo cubano.
Razón por la cual ni la Izquierda, ni la Derecha cubana tienen poder de convocatoria real, espontánea; llena de júbilo, alegría y orgullo dentro de Cuba como el que existio bajo la la Constitucion de 1940.
Y en el peor de los casos, de ustedes seguir con esa terquedad politica de no reconocer la Constitucion de 1940 como la única Soberana, lo mas probable es que tras la muerte de Raul Castro; ustedes provoquen una Guerra Civil entre Caudillos Proyectista y un bano de sangre, en un pueblo que cada día se desangra mas politica, económica, moral y socialmente.
Los constitucionalistas sabemos que en las Revoluciones cubanas primero llega la venganza y despues la Ley. Es decir, no son Fuentes de Derechos como nos habían dicho; sino fuentes de delitos. Tampoco superan los Derechos que ya estan en la Constitucion de 1940.
Con la Restitución de la Constitucion de 1940 desde el minuto cero; primero llegaria la Ley y la Justicia, antes que la venganza.
También en su Titulos final la Constitucion de 1940 contiene todas las maneras en las que se puede hacer Reformas específicas, parciales e integrales (es decir, hacer una nueva) a una Constitucion. Incluso es tan increible, que va mas alla que eso; permite restringir nuestra soberanía como hicieron los paises europeos por el bien común de sus pueblos al integrarse como la Comunidad Europea.
Creemos que en el pueblo de Cuba todavía hay personas con la inteligencia politica suficiente para evitar tomar el camino mas largo y sangriento, para darnos cuenta que la Constitucion de 1940 a parte de ser Soberana y Legal; es el único marco y ambiente jurídico donde todos podemos conversar, sin que los que tengan mas dinero y poder le saquen ventajas a los que no lo tienen.
Como demuestra la historia de Cuba desde 1940 a la fecha, solo dentro de Constitucion de 1940 se puede construir una reconciliación política sólida y perdurable.
La Izquierda y la Derecha si quieren tener poder de convocatoria real dentro del pueblo cubano, dentro de ese pueblo que se ha vuelto apático políticamente por su culpa, por su incapacidad para ejecutar en la práctica el juego político normal, ese que se hace en cualquier país libre y desarrollado, ese que alterna el poder en base a lo que decide el soberano en cada elección; deben madurar políticamente y no seguir cometiendo el mismo error de profanar la Constitucion de 1940 una y otra vez, esperando nuevos resultados; cuando en la práctica lo que logran es agregar mas separacion familiar, mas infelicidad, mas sufrimientos, mas sacrificios, mas presos y muerto que los que ya ha contado el pueblo cubano desde 1952.

Queremos aclarar algo, para que no hayan malentendidos, ni rumores mal intencionados; no estamos hablando de negociar, ni de dialogar con nadie; estamos hablando de que primero la Izquierda y la Derecha cubana debe aceptar la Constitucion de 1940 como las reglas políticas legales para un verdadero diálogo.
Esto deja bien claro que los constitucionalistas cubanos no somos un Partido Político, sino cubanos de apie que pensamos distinto, que tenemos ideas distintas, con un abismo de contradicciones políticas entre nosotros; pero que al contrario de ustedes si tenemos un factor común que nos une de verdad y nos eleva por encima de esas diferencia personales:
La lucha por la Restitución de la Constitucion de 1940.
Por tanto:
La solución al Caso Cubano es mas fácil de lo que creen y requiere menos esfuerzos de los que han hecho:
Restituyase la Constitucion de 1940 y todos esos EFECTOS COLATERALES que tanto los atormentan hoy, que tanto denuncian, de los que tanto hablan en cada Foro para la añorada unidad entre los cubanos; irán desapareciendo paulatinamente en muy poco tiempo tras la Restitución de la Constitucion de 1940.
Entonces:
Los cubanos no entendemos porque si eso es así (que los es):
1-Los paises libres nunca hablan de la Constitucion de 1940.
2-Ni estimulan a que los líderes de la Oposicion Cubana que ayudan con dinero; hablen de Restituir la Costitucion de 1940.
3-Ni tampoco nos ayudan a nosotros los Constitucionalistas y al pueblo a luchar por Restituir la Constitución de 1940; que es puro amor al cubano.
4-No entendemos porque solo hablan de los miles de EFECTOS COLATERALES que ha traído para los cubanos la violación de la Constitucion de 1940; pero sin mencionarla.
Petición de un grupo de Cubanos Constitucionalistas a todos los líderes y hombres libres de este mundo:
Cada vez que hablen del Caso Cubano:
1-Hágalo en pocas palabras para que todos en el Mundo nos entienda.
2-Haganlo con el mismos lenguaje que habla el mundo libre en el siglo XXI, para que todo el Mundo nos entienda: El lenguaje constitucional.
3-Haganlo sin las confusiones que se han creado hasta ahora de tanto divagar por los EFECTOS COLATERALES que provoca la violación de la Constitucion de 1940; para que todo el Mundo nos entienda.
4-Haganlo sin repetir todo lo que ya se ha repetido hasta el cansancio en todos los Foros sobre el Caso Cubano, en todos los medios de comunicación masiva, desde 1952 y desde 1959; para que todo el Mundo nos entienda.
Repetimos:
Acaben con la confucion de introducir miles de temas superfluos en la solución del Caso Cubano.
Acaben con la confucion de introducir miles de EFECTOS COLATERALES.
Clarifiquen el Caso Cubano a ver si el mundo acaba de entendernos y nos ayuda de verdad.

Did you know that we Cubans also have a Sovereign Constitution like you?
Like its Sovereign Constitutions, our Sovereign Constitution of 1940 (by its better known acronym C-40), is the only one made by Cubans without the interference of foreign powers; plus:
It has never been repealed by the Sovereign Cuban People; because it was never Restored either!
Contrary to what has been said in all the World Political Forums since 1952, or from Havana, Miami, Washington, Madrid, Toronto, the UN, the OAS, the Vatican, the European Parliament, the European Community and other internal conversations between free governments and Western international institutions:
1-In Cuba we do not have an economic problem, a social problem, a cultural problem, an artistic problem, a problem of freedom of expression, an ideological problem, a military problem, ... or that we do not have founding thinking as a nation.
2-In Cuba we do not have a problem of lack of abundance of natural resources, an aggressive climate, we are not isolated in the middle of an ocean, in Cuba there is no hunger because we only have one agricultural harvest a year, because we are a small country 106 among 240 countries); neither do we have a problem of geographic fatalism, or geopolitical fatalism.
3-In Cuba we do not have a migratory problem as they say now, of a springboard type, or of a family chain to the US from the Florida Strait or through dozens of countries.
4-Nor do we believe that the solution to the Cuban Case is to MAKE COMPLAINTS about the abuses, the repression, the beatings, the fines, the kicks, the trials, the imprisonments, the torture, the murders; as has been done for 62 years and apparently many intend to continue doing it to infinity.
5-Not even in essence, it is a legal problem or violation of Human Rights; because the Charter of Human Rights is not binding on any country, but only that; a Letter of Intent that no country is obliged to fulfill at the level that it is obliged to comply with its Sovereign Constitution.
All of the above that we list is only a part of the thousands of COLLATERAL EFFECTS caused by the violation of the Constitution of 1940 or what is the same:
They are the COLLATERAL EFFECTS of the continuous coup d'état to the Constitution of 1940 since 1952, by the Cuban Project Caudillos.

In Cuba we only have one problem; which is Political and is solved by restoring the Constitution of 1940.
The Cuban problem is purely political, because since 1952 the Left has to be seated at the same table that in 1959 kidnapped the power that desecrated the Constitution of 1940 with the Basic Law and is now governed by its continuity, the Constitution of 2019 and the Right who wants a New Constitution, more or less in the style of the Constitutive Statutes of Batista, those that also desecrated the Constitution of 1940 or, failing that, the Restitution of the Constitution of 1901, that for not being sovereign, for not defending the people Cuban if it was sovereignly repealed in 1940, and that 69-year-old gentlemen show that it is politically impossible to achieve; because they divide the Cuban Case into two ideological solutions, into two exclusive ideas, into two antagonistic Forums and that is why the majority of the people are left out of the solutions that you intend to give to the Cuban Case, which leads in the end that the group that takes power at each stage, has to resort to violence to impose on the people who remained outside the dialogue, their personal project.
This political dialogue of national reconciliation would only be possible through a common sovereign, legal factor, of political unity, which has within itself all our founding thought, all the wishes of the Mambises, that of the independentists of the 1st Republic; something that contains a true balance where from our personal interests and tastes, all Cubans win something:
And those requirements gentlemen are only met by the Constitution of 1940!
Anything other than the Restitution of the Constitution of 1940, apart from being illegal, being a Fundamental Law of a small group with power or money; In the best of cases, it will only maintain the same current state of political apathy and yawning that the Left and Right now provoke in the Cuban people.
Reason why neither the Left nor the Cuban Right have the power of real, spontaneous convocation; full of jubilation, joy and pride within Cuba like the one that existed under the Constitution of 1940.
And in the worst case, you continue with that political stubbornness of not recognizing the Constitution of 1940 as the only Sovereign, most likely after the death of Raul Castro; You provoke a Civil War between Project Caudillos and a bloodbath, in a town that is bleeding more politically, economically, morally and socially every day.
We constitutionalists know that revenge comes first in Cuban Revolutions and then the Law. That is, they are not Sources of Rights as they had told us; but sources of crime. Nor do they exceed the Rights that are already in the Constitution of 1940.
With the Restitution of the Constitution of 1940 from minute zero; Law and Justice would come first, before revenge.
Also in its final Titles the Constitution of 1940 contains all the ways in which specific, partial and comprehensive reforms (that is, make a new one) to a Constitution can be made. It is even so incredible, that it goes further than that; It allows us to restrict our sovereignty as the European countries did for the common good of their peoples by integrating as the European Community.
We believe that in the Cuban people there are still people with enough political intelligence to avoid taking the longest and bloodiest road, to realize that the Constitution of 1940 apart from being Sovereign and Legal; It is the only legal framework and environment where we can all talk, without those with more money and power taking advantage of those who do not have it.
As the history of Cuba from 1940 to date shows, only within the Constitution of 1940 can a solid and lasting political reconciliation be built.
The Left and the Right if they want to have real convening power within the Cuban people, within that people who have become politically apathetic because of them, because of their inability to play in practice the normal political game, that which is played in any free and developed country, one that alternates power based on what the sovereign decides in each election; they must mature politically and not continue making the same mistake of desecrating the Constitution of 1940 over and over again, waiting for new results; when in practice what they achieve is to add more family separation, more unhappiness, more suffering, more sacrifices, more prisoners and deaths than those that the Cuban people have already counted since 1952.

We want to clarify something, so that there are no misunderstandings or ill-intentioned rumors; We are not talking about negotiating or dialoguing with anyone; We are talking about the fact that first the Cuban Left and Right must accept the Constitution of 1940 as the legal political rules for a true dialogue.
This makes it very clear that we Cuban constitutionalists are not a Political Party, but rather ordinary Cubans who think differently, who have different ideas, with an abyss of political contradictions between us; But that contrary to you if we have a common factor that truly unites us and elevates us above those personal differences:
The fight for the Restitution of the Constitution of 1940.
Therefore:
The solution to the Cuban Case is easier than you think and requires less effort than you have done:
Reinstate the Constitution of 1940 and all those COLLATERAL EFFECTS that torment them so much today, that they denounce so much, of which they speak so much in each Forum for the longed for unity among Cubans; They will gradually disappear in a very short time after the Restitution of the Constitution of 1940.
Then:
We Cubans do not understand why if that is so (which it is):
1- Free countries never speak of the Constitution of 1940.
2- Nor do they encourage the leaders of the Cuban Opposition who help with money; Talk about Restoring the 1940 Constitution.
3- Nor do the Constitutionalists and the people help us to fight to restore the Constitution of 1940; which is pure love for the Cuban.
4- We do not understand why they only speak of the thousands of COLLATERAL EFFECTS that the violation of the Constitution of 1940 has brought for Cubans; but without mentioning it.

3-Do it without the confusion that has been created up to now from so much wandering about the COLLATERAL EFFECTS caused by the violation of the Constitution of 1940; so that everyone understands us.
4-Do it without repeating everything that has already been repeated ad nauseam in all the Forums on the Cuban Case, in all the mass media, since 1952 and since 1959; so that everyone understands us.
We repeat:
End the confusion of introducing thousands of superfluous issues in the solution of the Cuban Case.
Get rid of the confusion of introducing thousands of SIDE EFFECTS.
Clarify the Cuban Case to see if the world has just understood us and really helps us.
Summarize the Cuban Case before the World in a single Sentence and in a single Solution:
Ask only for the immediate Restitution of the Constitution of 1940, which is the only one that will bring us Justice, Peace and Freedom!
